A federal district court judge has shaved five months off the sentence of one of two East Helena brothers now serving time for his role in the Jan. 6, 2021 insurrection.
The move came as part of U.S. sentencing guidelines that allow for a reduction for defendants with no criminal history and other criteria.
U.S. District Court Judge Timothy Kelly ruled July 1 in the District of Columbia that Joshua Calvin Hughes now has to serve 33 months instead of the 38 months that he was sentenced to Nov. 22, 2022.
The eight-page ruling stated Hughes was eligible for the reduced sentence under the “retroactively applicable amendment” and that it was warranted after considering the relevant factors, Kelly said.
The government had argued that Hughes was present in or near a mob in which others were violent or made threats and that he also used credible threats of violence.
