Justin Timberlake’s lawyer denies that the pop star was drunk when he was arrested for driving while intoxicated in New York’s Sag Harbor Village in June.
In a statement provided to Court TV, attorney Edward Burke, Jr. claimed that Timberlake “should not have been arrested” and criticized the Suffolk County District Attorney’s Office for making “significant errors” in the case.
The DA’s Office acknowledged a “ministerial error in the original accusatory instrument” and stated that an amended instrument was filed on July 2, 2024, correcting the error while maintaining the facts of the case.

Timberlake is set to be arraigned on Aug. 2, according to the DA’s Office.
The DA stated to Court TV, “We stand ready to litigate the underlying facts of this case in court, rather than in the press.”
Despite this, Burke, Jr. expressed confidence that the charge against Timberlake will be dismissed.
Timberlake was taken into custody in the early morning hours of June 18 while driving a BMW, allegedly failing to stop at a stop sign and maintain his lane while driving.
Police stated shortly after the arrest that “upon investigation, it was determined that Mr. Timberlake was operating his vehicle in an intoxicated condition.”
An officer reported noticing Timberlake with bloodshot eyes and slurred speech, mentioning that the singer had difficulty standing up.
