The U.S. Food and Drug Administration has lifted its ban on JUUL products, potentially allowing the brand to reintroduce its e-cigarettes and vapes to the market.
The FDA had initially issued marketing denial orders to JUUL Labs in June 2022, preventing the company from selling devices and tobacco and menthol-flavored pods. The agency cited concerns over the products’ toxicological profile not meeting public health standards. However, after JUUL filed an appeal, the products were allowed to remain on the market.
Recently, the FDA announced that new case law and its review of information provided by JUUL led to the cancellation of the previous marketing denial orders. JUUL’s premarket tobacco product applications are now back in review with no definitive authorization or denial from the FDA yet.
JUUL stated in a statement that its devices and pods subject to the applications will remain available for purchase during the review process. The company expressed appreciation for the FDA’s decision and expressed readiness to engage in a science-based process for marketing authorization.
Despite its controversies, JUUL remains a top-selling e-cigarette brand, particularly among young users. The brand has faced criticism for its role in youth vaping, with concerns raised by the CDC and U.S. Surgeon General about the brand’s impact on underage users.
