A lawsuit has been filed against Netflix by a woman who believes the stalker character Martha in “Baby Reindeer” was based on her, alleging that the show has defamed her and negatively impacted her life since its release.
“Baby Reindeer” is set in 2015 and tells the story of writer and creator Richard Gadd, who also plays the lead role of Donny Dunn, a struggling comedian and bartender. One day, Dunn encounters Martha, a distraught character played by Jessica Gunning, who later becomes his stalker, engaging in various disturbing behaviors before being arrested and imprisoned in the series.
Despite claims from the show’s creators that Martha is not directly based on a real person, Fiona Harvey argues that her reputation has been tarnished by the character’s actions in the show. She filed a lawsuit in federal court in Los Angeles, stating that the portrayal of Martha has led to false allegations and defamation against her.
Harvey specifically disputes the show’s claim that it is a “true story” and challenges the characterization of Martha, which includes criminal behavior and violence that she insists are entirely fabricated. She also points to instances where the show implied her involvement, causing further damage to her reputation and causing distress.
The lawsuit seeks $170 million in damages for defamation, emotional distress, negligence, and violations of her right to privacy. Netflix has stated that they will vigorously defend the lawsuit, supporting Gadd’s right to tell his story.
While “Baby Reindeer” gained popularity on Netflix, Gadd has discouraged viewers from speculating on the real-life inspirations for the characters. Jessica Gunning, who portrayed Martha, has clarified that she was not aware of any real-life connection to the character during filming.
